Imagine arranging a beautiful marriage in the United States only to have it ruined by a lengthy court process that tries to accuse your entire relationship as fraud.

As xenophobic sentiments continue to manifest in the United States, the legitimacy of many immigrant marriages are now being questioned.

More specifically, the U.S. immigration office is now starting to crack down on the common loophole within the immigration system that allows immigrants who marry U.S. citizens to avoid the lengthy immigration process.

These so-called “green card” marriages are extremely problematic because they can be confused with legitimate marriages. In the United States where immigrant sentiments are polarized, even immigrant marriages arranged in good faith now being scrutinized by the U.S. Immigration and Services.

These recent changes only emphasizes the importance of clearing any conditional green cards. In America, it is better to be safe than sorry. Having a conditional green card only opens the possibility of future investigation, so legal action with the right counsel is highly advised.

If a marriage that grants permanent residence is less than 2 years old, the new green card becomes conditional. The U.S. Immigration and Services office integrated this rule to deter fake marriages.

There are various ways to earn a permanent, non-conditional green card. Methods range drastically and is unique for each case. Successful cases in the past have included but are not limited to: proof of continued marriage after the two years and widows who entered the marriage in good faith.

To summarize a “conditional green card”, is essentially the phase where new applicants must prove to the U.S. Immigration and Services office that the marriage was not an elaborate method to evade immigration laws.
